ಡ್ರಾಕೋನಿಯನ್ ಸಂವಿಧಾನ

ಕ್ರಿ.ಪೂ 7 ನೇ ಶತಮಾನದ ಅಂತ್ಯದ ವೇಳೆಗೆ ಅಥೆನಿಯನ್ ಶ್ರೀಮಂತ ವರ್ಗದ ಮೌಖಿಕ ಕಾನೂನುಗಳನ್ನೇ ಅಳವಡಿಸಿ ಡ್ರಾಕೊ ರಚಿಸ

ಡ್ರಾಕೋನಿಯನ್ ಸಂವಿಧಾನ, ಅಥವಾ ಡ್ರಾಕೋ ಸಂಹಿತೆ, ಕ್ರಿ.ಪೂ 7 ನೇ ಶತಮಾನದ ಅಂತ್ಯದ ವೇಳೆಗೆ ಅಥೆನಿಯನ್ ಶ್ರೀಮಂತ ವರ್ಗದ ಮೌಖಿಕ ಕಾನೂನುಗಳನ್ನೇ ಅಳವಡಿಸಿ ಡ್ರಾಕೊ ರಚಿಸಿದ ಲಿಖಿತ ಕಾನೂನು ಸಂಹಿತೆಯಾಗಿದೆ. [೧]

ಇತಿಹಾಸ ಬದಲಾಯಿಸಿ

ಕ್ರಿ.ಪೂ ಏಳನೇ ಶತಮಾನದ ಮಧ್ಯಭಾಗದಲ್ಲಿ ಗ್ರೀಸ್‌ನ ಹಲವು ಸಮುದಾಯಗಳು ಅನುಸರಿಸುತ್ತಿದ್ದ ಮೂಲ ಕಾನೂನನ್ನು ಕ್ರೋಡೀಕರಿಸಿ ಡ‍್ರಾಕೋ ಈ ಸಂಹಿತೆಯನ್ನು ರೂಪಿಸಿದ. [೨] [೩] ಈ ಡ್ರಾಕೋನ ಸಂಹಿತೆಯು ಹೊರಹೊಮ್ಮುವವರೆಗೂ ಅಥೇನ್ಸ್ ನ ಶ್ರೀಮಂತ ವರ್ಗದವರು ಮೌಖಿಕ ಕಾನೂನನ್ನೇ ತಮಗೆ ಅನುಕೂಲವಾಗುವಂತೆ ಅನುಸರಿಸುತ್ತಿದ್ದರು. [೪] [೫] ಅಥೆನ್ಸ್‌ನ ಜನರು ಕ್ರಿ.ಪೂ. 621 ರ ಸುಮಾರಿಗೆ ಲಿಖಿತ ಕಾನೂನು ಸಂಹಿತೆ ಮತ್ತು ಸಂವಿಧಾನವನ್ನು ರೂಪಿಸಲು ಡ್ರಾಕೊನನ್ನು ನಿಯೋಜಿಸಿದರು, ಡ್ರಾಕೋಗೆ ಅಥೆನ್ಸ್‌ನ ಮೊದಲ ಶಾಸಕನ ಪಟ್ಟವನ್ನು ನೀಡಿದರು. ಈ ಕಾನೂನು ಸಂಹಿತೆಯನ್ನು ಸರ್ವವರಿಗೂ ಪ್ರವೇಶವಿರುವಂಥಹ ಸ್ಥಳದಲ್ಲಿ ಇರಿಸಲಾಯ್ತು. ಇದರಿಂದ ಡ್ರಾಕೋನ ಸಂಹಿತೆಯನ್ನು ಯಾರೂ ಬೇಕಾದರೂ ಓದಿ ತಿಳಿದುಕೊಳ್ಳುವ ಅವಕಾಶವನ್ನು ಕಲ್ಪಿಸಲಾಯ್ತು. ಇದು ಅಥೇನಿಯನ್ ಪ್ರಜಾಪ್ರಭುತ್ವದ ಆರಂಭಿಕ ಅಭಿವ್ಯಕ್ತಿಯಾಗಿತ್ತು.

ಹಿನ್ನೆಲೆ ಬದಲಾಯಿಸಿ

ಕ್ರಿಸ್ತಪೂರ್ವ ೭ನೇ ಶತಮಾನದಲ್ಲಿ ಅಥೆನ್ಸ್ ನ ಆಡಳಿತವು ಶ್ರೀಮಂತ ವರ್ಗದ ಹಿಡಿತದಲ್ಲಿತ್ತು. ಈ ವರ್ಗದವರು ರೂಪಿಸಿದ ಮೌಖಿಕ ಕಾನೂನು ಚಾಲ್ತಿಯಲ್ಲಿಯಿತ್ತು. ಇದರಿಂದ ಸಮಾಜದ ಇತರ ವರ್ಗಗಳು ಶೊಷಣೆಗೆ ಕಾರಣವಾಗಿತ್ತು. ಕಾನೂನಿನ ತಿದ್ದುಪಡಿಗಳು ಕೂಡ ಶ್ರೀಮಂತ ವರ್ಗದ ಅನುಕೂಲವಾಗುವಂತೆ ಇರುತ್ತಿದ್ದವು. ಇದರಿಂದ ಇತರ ವರ್ಗಗಳಲ್ಲಿ ಅಸಮಾಧಾನ ಮೂಡಲು ಪ್ರಾರಂಭವಾಯ್ತು.

ಈ ಅಸಮಾಧಾನವನ್ನು ಕಡಿಮೆ ಮಾಡುವ ಉದ್ದೇಶದಿಂದ, ಅಥೆನ್ಸ್‌ನ ಆಡಳಿತ ಹಾಗೂ ಶ್ರೀಮಂತ ಕುಟುಂಬಗಳು ತಮ್ಮ ಹೊಸ ಕಾನೂನು ಪ್ರಸ್ತಾಪಗಳು ಮತ್ತು ತಿದ್ದುಪಡಿಗಳನ್ನು ತ್ಯಜಿಸಲು ನಿರ್ಧರಿಸಿದರು ಮತ್ತು ಅವುಗಳನ್ನು ಲಿಖಿತವಾಗಿ ಅಥೇನಿಯನ್ ಸಮಾಜಕ್ಕೆ ಪ್ರಚಾರ ಮಾಡಲು ನಿರ್ಧರಿಸಿದರು. ಶ್ರೀಮಂತ ವರ್ಗಕ್ಕೆ ಸೇರಿದ ಡ್ರಾಕೋನನ್ನು ಶಾಸಕನಾಗಿ ನೇಮಿಸಿದರು. [೬] ಡ್ರಾಕೋ ,ಕ್ರಿಸ್ತಪೂರ್ವ ೬೨೧ ಲಿಖಿತ ಸಂವಿಧಾನದ ಪಠ್ಯ ಬರೆಯಲು ಆರಂಭಿಸಿದನು. ಹೊಸ ಸಂವಿಧಾನವನ್ನು ಎಲ್ಲರಿಗೂ ಓದಲು ಲಭ್ಯವಿರುವಂತೆ ಪಠ್ಯವನ್ನು ಕೆತ್ತಲಾಯಿತು. [೭] ಇದರ ಪರಿಣಾಮವಾಗಿ, ಡ್ರಾಕೋನಿಯನ್ ಸಂವಿಧಾನವನ್ನು ಓದುವಂಥಹ ಅವಕಾಶ ಅಥೆನ್ಸ್ ನಾಗರಿಕರಿಗೆ ದೊರೆಯಿತು .

ಡ್ರಾಕೊ ಉದ್ದೇಶಪೂರ್ವಕ ಮತ್ತು ಉದ್ದೇಶಪೂರ್ವಕವಲ್ಲದ ನರಹತ್ಯೆಯ ಪರಿಕಲ್ಪನೆಗಳನ್ನು ಪರಿಚಯಿಸಿದನು, [೮] ಎರಡೂ ಅಪರಾಧಗಳನ್ನು ಅರಿಯೋಪಗಸ್‌ನಲ್ಲಿ (ಪ್ರಾಚೀನ ಗ್ರೀಕ್ ನ್ಯಾಯಾಲಯ) ತೀರ್ಮಾನಿಸಲಾಗುತ್ತಿತ್ತು. [೯] . ಕ್ರಿ.ಪೂ 6 ನೇ ಶತಮಾನದ ಆರಂಭದಲ್ಲಿ ಅನುಸರಿಸುತ್ತಿದ್ದ ಸೊಲೊನಿಯನ್ ಸಂವಿಧಾನ ಡ್ರಾಕೋನ ಎಲ್ಲಾ ಸಂಹಿತೆಗಳನ್ನು ಬದಳಾಯಿಸಿದರೂ ನರಹತ್ಯೆಯ ಕಾನೂನುನನ್ನು ಮಾತ್ರ ಹಾಗೇ ಉಳಿಸಿಕೊಂಡಿತು. [೧೦]

ಪೂರ್ಣ ಡ್ರಾಕೋನಿಯನ್ ಸಂವಿಧಾನವು ಈಗ ಲಭ್ಯವಿಲ್ಲ, ಆದರೆ ಸೇಬನ್ನು ಕದಿಯುವಷ್ಟು ಸಣ್ಣ ಅಪರಾಧಗಳಿಗೆ ಶಿಕ್ಷೆಗೊಳಗಾದವರಿಗೆ ಕಠಿಣ ಶಿಕ್ಷೆಗಳನ್ನು ವಿಧಿಸಲಾಗುತ್ತಿತ್ತು ಎಂದು ವರದಿಯಾಗಿದೆ. [೧೧] ಡ್ರಾಕೋನಿಯನ್ ಸಂವಿಧಾನವನ್ನು ಉಲ್ಲಂಘಿಸಿದ ಎಲ್ಲ ಆರೋಪಿಗಳಿಗೆ [೧೨] ಒಂದೇ ಒಂದು ದಂಡ, ಅದು ಮರಣದಂಡನೆ. ಕಾನೂನುಗಳನ್ನು ಶಾಯಿಯ ಬದಲು ರಕ್ತದಲ್ಲಿ ಬರೆಯಲಾಗುತ್ತಿತ್ತು ಎಂದೂ ಹೇಳಲಾಗಿದೆ. [೧೩] ಕ್ರೂರ ಅಥವಾ ಅಮಾನವಿಯ ಕಾನೂನುಗಳಿಗೆ ಇಂದು "ಡ್ರಾಕೋನೀಯನ್" ಎಂಬ ಪದದ ಬಳಕೆ ಮಾಡುವುದನ್ನು ಕಾಣಬಹುದು. [೧೪]

ಡ್ರಾಕೊನ ಸ್ಥಾನ ಬದಲಾಯಿಸಿ

ಅರಿಸ್ಟಾಟಲ್‌ ಅಥೇನಿಯನ್ನರ ಸಂವಿಧಾನವನ್ನು ಪರಿಚಯಿಸುವರೆಗೂ ಡ್ರಾಕೋನನ್ನು ರಾಜಕೀಯ ಸುಧಾರಕ ಎಂದು ಪರಿಗಣಿಸಲಾಗಿರಲಿಲ್ಲ. ಡ್ರಾಕೋನಿಯನ್ ಸಂವಿಧಾನವನ್ನು ಸಮಕಾಲೀನ ಇತಿಹಾಸಕಾರರು ಉಲ್ಲೇಖಿಸದಿದ್ದರೂ, ಅರಿಸ್ಟಾಟಲ್‍ನ ಪ್ರಕಾರ ನರಹತ್ಯೆಯಂಥಹ ಅಮಾನವಿಯ ಕಾನೂನನ್ನು ಪರಿಚಯಿಸಿದ ಹೊರತಾಗಿಯೂ ರಾಜಕೀಯ ಮತ್ತು ಸಾಂವಿಧಾನಿಕ ಸುಧಾರಕನಾಗಿ ಡ್ರಾಕೋನ ಮಹತ್ವದ ಸ್ಥಾನ ಪಡೆಯುತ್ತಾನೆ .
