ವರ್ಣಚಿತ್ರ, ರೇಖಾಚಿತ್ರ ಅಥವಾ ಛಾಯಾಚಿತ್ರಗಳ ಪ್ರತಿಗಳು ಇವುಗಳನ್ನು ಒಳಗೊಂಡಿಲ್ಲ ಎಂಬುದನ್ನು ಗಮನಿಸಿ, ಉಲ್ಲೇಖಿಸಿದ ಷರತ್ತುಗಳ ಅಡಿಯಲ್ಲಿ ಅವು ಬರುವುದಿಲ್ಲ (iii). ಇವು ಷರತ್ತು ಅಡಿಯಲ್ಲಿ ಬರುತ್ತದೆ (i).

(i) ಕಲಾತ್ಮಕ ಕೆಲಸವು ಸಾರ್ವಜನಿಕ ಸ್ಥಳದಲ್ಲಿ ಅಥವಾ ಸಾರ್ವಜನಿಕರಿಗೆ ಪ್ರವೇಶ ಹೊಂದಿರುವ ಯಾವುದೇ ಆವರಣದಲ್ಲಿ ಶಾಶ್ವತವಾಗಿ ಇರುತ್ತದೆ;
